Navigating an accident as a participant, from start to finish.

1 Treat your injuries

After you've been involved in a traumatic incident that causes you personal injury, it is imperative that you seek medical treatment as soon as possible from your family doctor or a hospital in the case of severe personal injury.

Some injuries, such as fractured bones or soft tissue injuries, may be apparent immediately after the incident. However, other injuries, including psychological trauma, concussions, or some soft tissue injuries may not present until many weeks after an incident. Your doctor or treatment providers will assist you in diagnosing your injuries and working with you to develop a treatment plan. 

Recommended treatments may include physiotherapy, massage therapy, chiropractic adjustments, or even dental treatments or psychological counseling. If applicable, those treatments should be covered by plans such as vehicle insurance or health benefits plans. 

After undergoing a treatment program, your coverage may be discontinued. If you feel you need additional treatment, or if you have difficulty affording treatment when insurance benefits are exhausted, we can explain your options regarding obtaining further coverage so that you may continue in your recovery.

2 The legal claim

Once you’ve been checked out by a doctor and consulted your insurance company, you can decide if you want to pursue legal action. Generally, you have two years from the date of the accident to file a personal injury claim, but there are exceptions to this deadline -- some deadlines can be as short as three weeks, depending on the circumstances. Contact us as soon as you are able in order to see which deadlines may apply to you and to learn your rights, even if you aren't sure you want to retain a lawyer.

Your first meeting with us will be an exploration of the incident. We’ll give you our honest opinions about your case, if we can represent you, and what your options will be moving forward.

Once you've retained us, we will be your representative until the claim is finished. All communications with the defendants and their insurers will go through us.

We will assist you in gathering evidence to prove your injuries and other losses such as income or employment losses, treatment needs or difficulties in your day-to-day life.

Every case is different. However, we will guide you through the various stages of the legal process which may include meetings with other lawyers, medical examinations, or court appearances.  

3 Resolving your claim

After we've gathered all the necessary evidence to advance your personal injury claim, we will pursue a resolution with the defendants and their insurers. 

We'll do our best to achieve a compromised, negotiated settlement whenever possible that allows you to move forward with your life without the cloud of legal proceedings hanging over you. This can be accomplished by way of negotiated resolution or in some cases, mediation. However, if we can’t strike a deal out of court, our lawyers are prepared to take your claim to trial. We’ll prepare you, our witnesses and experts to put your best foot forward in order to show your losses and prove your claim.
